Stressses large "Virginia property owners' vested right to develop properties" without local government restriction

"In recent months, I enjoyed representing Brentsville citizens' interests in one of the most challenging and complex developments to come before the Board - Brentswood.  Amidst the facts, rumors, allegations, as an elected official, I stand publicly for one thing and one thing only: to ensure that any idea proposed in Brentsville is guaranteed a fair, balanced, factual airing. Every citizen is entitled to equal access to the democratic process.

"Legislating public policy is by nature, dynamic. Financed road construction projects assumed to be adequately funded today, can escalate in price and lose feasibility. Sources of general revenue can be and are redirected in the event of unforeseen expenses. Projects like Brentswood can be revamped. But the legislative process doesn't change. All requests for rezoning require a public hearing.

"Virginia property owners have a vested right to develop properties. Local governments cannot restrict this right for a greater public good or require property owners to construct adequate public facilities like schools, roads, and libraries. These amenities are only obtained through the voluntary proffer process through individual, private negotiation with the developer. Proffers come only with rezoning cases, like Brentswood, in contrast to 'by right' development, (e.g. 1 house per 10 acres) as designated in the Comprehensive Plan.

"We have a proven track record of delivering proffers to Brentsville to finance public facilities, specifically requesting that transportation proffers be paid for 'up front.' These advances, coupled with County bond funds and recordation fees have stepped up and are currently accelerating road projects across the County. I continue to press for transportation dollars, school sites, and parks in any Brentsville rezoning that comes to my attention.
